March 10, 2020 – In a class certification order unsealed today, partner Elizabeth C. Pritzker has been appointed as Co-Lead Class Counsel in In re: EpiPen Marketing, Sales Practices and Antitrust Litigation. The judge presiding over the multidistrict litigation, the Hon. Daniel D. Crabtree of the United States District Court for the District of Kansas, appointed Ms. Pritzker to the position sua sponte. Ms. Pritzker previously served as Chair of the Plaintiffs’ Steering Committee in the case.
In the same order, Judge Crabtree certified a nationwide RICO class and several state antitrust classes. The claims in the litigation center on allegations that Mylan NV and Pfizer, Inc., the seller and manufacturer of the life-saving EpiPen, respectively, engaged in an unlawful scheme to sharply increase the price of the auto-injector while at the same time stifling competition by others seeking to enter the epinephrine auto-injector market.
