February 27, 2020 – The U.S. Court of Appeals for First Circuit has affirmed the jury verdict and $9.2 million judgment in favor of the firm’s German-based client, ITyX Solutions, achieved at trial by Jonathan K. Levine and Elizabeth C. Pritzker of Pritzker Levine LLP and co-counsel Scott Magee of Morse, Barnes-Brown & Pendleton, PC. The case is ITyX Solutions AG v. Kodak Alaris, Inc. After the jury found for Pritzker Levine’s client ITyX and rejected Kodak’s counterclaims, Kodak appealed. Pritzker Levine and Mr. Magee wrote a brief opposing the appeal, and Mr. Levine presented oral argument to the appellate court. In a forceful 28-page opinion, the First Circuit rejected Kodak’s appeal (except for a minor issue concerning damages) and upheld ITyX’s trial victory.
