June 12, 2019 – The Ninth Circuit today granted plaintiffs’ appeal of an unfavorable District Court order in Corcoran v. CVS that had granted CVS’s motion for summary judgment, struck the opinion of one of plaintiffs’ experts, and granted class certification only in part.

Following their successful appeal, plaintiffs’ case will be remanded to the District Court for further proceedings. Plaintiffs allege that CVS misrepresented the “usual and customary” prices of certain generic prescription drugs, causing customers to overpay for these drugs.
