The firm is currently active in a number of business litigation matters. Pritzker Levine represents BeUbiq, Inc., a Silicon Valley tech start-up, in a breach of contract action against a software development company that BeUbiq hired to develop the software platform for its principal product. The firm represents Airport Express, a San Francisco-based transportation company, in ongoing litigation against the San Francisco Airport Commission and the Director of San Francisco International Airport. Pritzker Levine also represents a local tech entrepreneur in an ongoing breach of contract, breach of fiduciary duty and derivative action arising from his ownership interests in several related limited liability companies and partnerships.
Pritzker Levine recently represented a local business owner who was sued for breach of contract and fraud in connection with the sale of a business. Following several months of litigation, the firm was able to obtain a dismissal with prejudice for its client. The firm also successfully represented a minority shareholder of a privately-held company who was being squeezed out of the business by the majority owner without providing fair value for her shares. After a complaint was filed, Pritzker Levine attorneys were able to negotiate a fair value for the purchase of the minority interest and a severance agreement for the client.
In the antitrust field, the firm currently represents two non-profit community development organizations, Massachusetts-based Lawrence Community Works and the San Francisco-based Tenderloin Neighborhood Development Corporation, in federal antitrust litigation against the manufacturers and sellers of gypsum wallboard (drywall). The firm recently represented Il Fornaio (America) Corporation, which owns and operates 21 full service restaurants, Oliveto Partners, Ltd., the Famous Enterprise Fish Company of Santa Monica, Inc., and a certified class of other restaurants and food distributors, in another federal antitrust case against distributors of mesquite lump charcoal that was settled in late 2014.
